Tennessee’s Constitution was adopted in 1870 and its language regarding slavery was mostly copied from the 13th Amendment to the Constitution of the United States of America. Article I, Section 33 of Tennessee’s Constitution reads: “That slavery and involuntary servitude, except as a punishment for crime, whereof the party shall have been duly convicted, are forever prohibited in this State.” If Amendment #3 is passed on November 8, 2022, the following section will be removed from Tennessee’s Constitution, thus forever prohibiting all slavery in Tennessee without exception: “…except as a punishment for crime, whereof the party shall have been duly convicted.” 5 states including Tennessee will attempt to pass constitutional amendments to remove slavery from their state constitutions this November 8th, 2022: Alabama, Louisiana, Oregon, Tennessee, and Vermont.
