Upcoming Art Walk! You’re invited to Madison Public Art Project’s (MPAP) upcoming neighborhood art walk. The MPAP is always looking for new ways to connect art & community. Jillian, the project curator, will lead a 1.5 hour walk that will showcase the painted hydrants of the Vibrant Hydrant Public Art project that unveiled on 9/11. This commissioned hydrant art was designed to to pay tribute to the firefighters, first responders, and those who lost their lives on 9/11/2001. Some artists may be in attendance and will share the meaning and inspiration behind each of their hydrant designs. The walk will be along the sidewalk on the Monona Drive Business district. There is a moderate incline hill. We will meet at the Kwik Trip located at 6400 Monona Drive and walk North. Then we will loop back down Monona Drive walking south and will view 13 painted hydrants with artistry by eleven Wisconsin artists. Vibrant Hydrant offers a creative way for neighbors and visitors to connect with public art in an urban environment. We know that art holds the power to bring communities together and to foster recovery and resilience. Art can address society’s challenges, and can be used to spark and ignite change as we work together toward a more inclusive and peaceful world. Join us to see this new artistic addition to the local landscape of Monona Drive. By signing up for this event you agree to the following terms below. WAIVER AND RELEASE OF LIABILITY Madison Public Art Project, Inc. By purchasing tickets for and participating in the upcoming event (collectively “Events”) offered by Madison Public Art Project (the "Company"), and in consideration for my being allowed to participate in the Tours, the receipt and sufficiency of which is hereby acknowledged, I, and if I am not yet 18 years old, my parent or legal guardian (individually and collectively referred to below in the first person singular) agree to be bound by each of the following provisions of this waiver, release of liability, indemnification, consent to medical attention and grant of rights (“Waiver”): 1. Voluntary Participation. I understand and confirm that my participation in the Event is voluntary. I am in good health and suffer from no physical or mental condition that would make me especially susceptible to injury or disability while participating in the Event. 2. Comprehension of Risk. I fully comprehend and accept all of the risks associated with my participation in the Event including, without limitation, injury or death resulting from exposure to unfavorable weather conditions, disease of any kind, food sickness, allergic reactions, choking, and injuries arising from self-inflicted accidents or mishaps, other participants, motor vehicles, bicycles, and pedestrians. I understand that the Events take place in public venues and spaces under conditions largely beyond Company’s control. 3. Assumption of Risk. I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my participation in the Events. I accept personal responsibility for any liability, injury, illness, loss, or damage in any way connected with my participation in the Events. 4. Release of Liability; Limitation of Damages. I hereby forever and unconditionally release Company and its affiliated entities, present and former employees, owners, officers, members, managers, partners, contractors, insurers, and board directors (collectively “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses (including, without limitation, attorney’s fees) for death, injury, loss or damage of property, (collectively “Claims”) in any way arising out of my participation in the Events, including, without limitation, any and all Claims resulting from the negligence of the Released Entities. 5. Indemnification. I agree to defend and indemnify the Released Entities from any and all Claims as incurred of any kind whatsoever in any way arising out of my participation in the Events. 6. Binding Effect. This Waiver shall be binding upon my next of kin, personal representatives, heirs, beneficiaries, and assigns and shall inure to the benefit of Company, its successors and assigns. 7. Consent to Medical Treatment. I authorize Company to provide to me, through medical personnel of its choice, customary medical assistance, transportation, and emergency medical services. This consent does not impose a duty upon Company to provide such assistance, transportation, or services. 8. Severability. If any provision of this Waiver is for any reason declared to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable, and if no modification may render it valid and enforceable, this Waiver will be construed as if not containing such provision and the rights and obligations of the parties will be construed and enforced accordingly. 9. Cancellation and Force Majeure. The Company hereby reserves the right to cancel the Events for any reason. Additionally, in the instance that the Events have commenced, the Company may cancel the remainder of such Events if, in the opinion of any employee or agent of the Company, there is sufficient reason to believe that the Participant may be in danger of injury or loss. This paragraph includes, but is not limited to, any act of God or unforeseeable event, such as natural disasters, pandemics, riots, acts of governing authorizes, or otherwise. In the event of cancellation of the Events, the Company shall reschedule the event. 10. Governing Law and Venue. This Waiver shall be governed in all respects by the laws of the State of Wisconsin without regard to conflict of law principles. Venue shall be in Dane County, Wisconsin. 11. Promotional Release. I hereby grant to Company the unrestricted right and permission to copyright and use photographic portraits, pictures, video footage and/or audio recordings of my participation in the Events, in which I may be included intact or in part, including the negatives, prints, transparencies or digital information relevant to such portraits (the “Material”). Company has the right to reproduce, exhibit, distribute, broadcast, digitize, edit, or otherwise use the Material, by any method and in any media, whether now existing or later created, without restriction throughout the world, by incorporating the Material into its website, publications, catalogues, brochures, books, magazines, or commercial, informational, educational, advertising, or promotional materials relating thereto (collectively, the "Works'). I agree that Company is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Material and the Works. The artists own the original art copyrights. Participant acknowledges that he or she has carefully read this Agreement and submits to all of the foregoing provisions. Further, Participant acknowledges that he or she enters into this Agreement under his or her own volition, and that Participant has been afforded the opportunity to review this Agreement with the attorney of his or her own choosing. Participant acknowledges that he or she is giving up substantial rights by agreeing to the provisions of this Agreement. If Participant is under the age of eighteen (18) years old, It is hereby acknowledged that Participant’s parent of legal guardian has read and consented to the terms of this Agreement. THIS IS A WAIVER AND RELEASE OF LIABILITY. I HAVE READ THIS ENTIRE DOCUMENT. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO ITS PROVISIONS. BY CONTINUING TO PARTICIPATE IN THE EVENTS, I AM INDICATING MY VOLUNTARY AGREEMENT TO THE PROVISIONS OF THIS WAIVER AND RELEASE OF LIABILITY. PARTICIPATION IN THE EVENTS BY A PERSON WHO IS NOT YET 18 YEARS OLD INDICATES THAT A PARENT OR LEGAL GUARDIAN HAS ALSO READ AND CONSENTED TO THIS WAIVER. Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to- person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Madison Public Art Project “MPAP”) has put in place preventive measures to reduce the spread of COVID-19; however, we cannot guarantee that you any minor you are responsible for will not become infected with COVID-19. Further, attending MPAP activities could increase your risk of contracting COVID-19. By registering for this event, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and any minor I am responsible for may be exposed to or infected by COVID-19 by attending MPAP activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at MPAP may result from the actions, omissions, or negligence of myself and others, including, but not limited to, MPAP employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death),illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at MPAP activities or participation in MPAP programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless MPAP, its employees, agents, board directors, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of MPAP, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any MPAP program, tour or activity.
