Description

Public welfare (Istislah) is also a term used in Islamic law. The Marek school of jurisprudence assists in legislation and judicial principles. The free translation of the Arabic "Istis Lah" originally means "public interest" or "welfare", also known as "Maslahah". Refers to the fact that jurists, when creating regulations, teaching judges in hearing cases, and deciding on the application of laws, out of the needs of the public interest, they may not stick to legal words, but adopt flexible methods and principles in order to obtain more just conclusions or judgment. For example, in order to maintain social order and enable people to live and work in peace and contentment, it is not restricted by the principle of homomorphic revenge (Kissas), and all partner murderers who have bad circumstances and cruel methods but only murder one person can be sentenced to death.
