Description
The 1st Amendment protects free speech, true or false, whether it’s meant to inform or to mislead. Compare this with testimony under oath, where a lie is perjury and can mean jail time. We have heard the testimony under oath of Republicans who served in the Trump White House. They knew he lost the election. He knew he lost the election.
The media are free to tell any false or misleading story they choose. Internet posters are free to pass it on. But people who testify under oath make a choice; tell the truth or plead the Fifth Amendment. Or, of course, perjure themselves and do the time.
