The 9th Amendment, which reads: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Of course Justice Harry Blackmun relied on substantive due process found opaquely in the 14th Amendment. This decision would result in the formation of the Federalist Society-a group of lawyers whom I don't associate with.
