What is incitement under the law? Incitement is not a crime under the First Amendment unless it meets certain criteria. First of all, it has to be intended to cause violence (and you infer that intent from the circumstances). It also has to be likely to cause violence. If I go downtown and I say to two drunks standing in front of a bank, "let's rob this bank right now", I haven't really incited anybody, because it's not very likely they'll rob the bank. If I say let's meet here tomorrow and rip things up, I'm not inciting because - in the words of the Supreme Court - where there is time for better counsels to prevail, the remedy for speech is more speech. The speech has to be likely to cause - and this is very important - imminent violent action. Saying the election was stolen doesn't say go destroy stuff. Saying there was election fraud by simple definition there is zero basis for violence to happen. During Trumps speach on Jan 6th he said "Peacefully and patriotically make your voices heard" Saying we're going to fight like hell once again thats just words. If you actually took the time to read the timeline once people started talking about violence and wanting to over throw the government. The FBI and DHS have every right to monitor and move in if the threat is elevated. It's called a terroristic threat so they can move in and make arrest prior to Jan 6th. They also could have taken those a serious threats and activated the National Guard prior to rather than after the attack started. Your going to believe what you want and ignore anything others try to explain. I know how the military operates when they get a threat and apparently that's not how the civilian sector takes threats. You enjoy your show and all enjoy living my life knowing how the events could have been handled better. You blame Trump and I will continue to blame personnel that knew ahead of time and failed to take terroristic threats seriously.
