YOUR PURCHASE IS YOUR SIGNATURE* This Agreement is for and in consideration for the undersigned guest (“Guest”) to obtain permission to use the swimming pool or other facilities on the Hotel McCoy property. All references to Guest (or “I”, “myself”) herein shall be deemed to also refer and apply to any minor child, children, or ward for whom I am responsible, as applicable, listed at the end of this Agreement. PLEASE READ CAREFULLY AND SIGN BELOW 1. I, the Guest signing below, wish to utilize the services, facilities, swimming pool (collectively, “Facilities”) offered by Hotel McCoy (the “Hotel”). 2. I am aware that there are risks associated with the use of certain Facilities, including, without limitation, the risk of slipping, tripping, falling, overexertion, equipment malfunction, collision with other participants, and drowning. I further understand that these risks may lead to injury, damage to or loss of property, and death. 3. I declare and affirm that I/we am/are in good medical and physical condition, and that the use of Hotel Facilities does not pose any known danger to my/our health. 4. I declare and affirm that I am aware that there is no lifeguard on duty in the pool area, and that I/we am/are (a) capable swimmer(s). 5. I hereby acknowledge that the use of the Hotel Facilities is voluntary, that I have been advised and am aware of the associated risks, and hereby agree to assume and accept the risks of property damage or loss, personal injury, or death. 6. As a condition of my/our use of such Facilities, I on behalf of myself, my child(ren), or ward(s) (if applicable), our heirs and assigns, expressly agree to indemnify and hold Hotel McCoy, LLC, Openstay Management, LLC, their respective owners, officers, directors, staff, servants, agents, employees and their heirs, successors and assigns (collectively, “Indemnitees”) harmless and forever discharge, waive and release said Indemnitees from any and all claims, demands, injuries, damages, or causes of action, and for all acts of active or passive negligence on the part of Indemnitees that I/we may have or acquire on account of bodily injury, mental injury, death and/or property damage or loss from any mishap, accident, loss, damage or injury suffered by my myself or others resulting from, connected with or caused by the use of the Hotel Facilities, including, but not limited to any injury resulting from the negligence of Indemnitees, mechanical defects, or failure of any equipment or devices used in such Facilities. The foregoing assumption of risk and release of Indemnitees applies to the entirety of the Hotel premises, including adjacent parking areas and sidewalks. 7. I/we agree to comply with all Hotel rules and policies, which include those listed at https://hotelmccoy.com/hotel-policies/, those posted throughout the Hotel premises, and any instructions or guidelines that are delivered verbally by Hotel personnel. I/we understand that these rules, policies, instructions and guidelines may be updated from time to time. I understand and agree that minor children must be accompanied by an adult at all times while on Hotel premises, and that my/our use of Hotel services and Facilities may be terminated immediately if my/our behavior is not in accordance with the above. 8. I understand that this waiver is governed by, and intended to be as broad and inclusive as permitted by the laws of the State of Arizona, that by signing this Agreement I may be giving up certain rights that I may otherwise be entitled to, and I agree that if any portion is held invalid, the remainder of this Agreement will continue in full legal force and effect. I further agree that the venue for any legal proceedings shall be in the State of Arizona, County of Pima. If this Agreement is for the use of Hotel Facilities by a minor under 18 years old, it must be signed by a parent or legal guardian of such child(ren); one parent or guardian may not sign on behalf of other children’s parents or guardians. I HAVE READ AND UNDERSTAND THE FOREGOING AND ACKNOWLEDGE MY CONSENT TO THE TERMS OF THIS AGREEMENT FOR MYSELF AND MY CHILD, CHILDREN, AND/OR WARD(S) (IF APPLICABLE) BY SIGNING THIS AGREEMENT.
