Top Shot is hosting a Watch Party in Miami! Heat fans! We're excited for this one. On Monday, May 23, we'll be hosting our first grass-roots community event at TOPGOLF Miami for Game 4 of the Eastern Conference Finals. We'll have food, drinks, lots of TVs, lots of golf balls to whack, and are also working on bringing in a local legend to come hang out and learn about Top Shot from you all. It'll be first come, first serve for the first 500 fans who arrive. Capacity will be limited, and the memories will be priceless. We look forward to hanging out with you there. Must be 21+ or older to attend. Please arrive early. Even if you have obtained an invite, the venue may have to limit entry for fire, safety and other regulations or other reasons. By participating in this activity (the “Activity”) you represent that you are aware and understand that there may be certain risks associated with participation in the Activity. You expressly assume the risk that you may be exposed to hazards and risks foreseen and unforeseen including, but not limited to, the risk of serious personal injury, emotional injury, death, property damage, and all other harms, risks and dangers associated with COVID-19. These injuries may be compounded by negligent emergency response or rescue operations of Dapper Labs, Inc. (the “Company”), its officers, directors, employees, agents, affiliates, successors, and assigns (collectively, “Releasees”). By participating in the Activity, you represent that you understand, acknowledge, and accept these risks, and none of the Releasees has tried to conceal, contradict or minimize my understanding of these risks. In addition, you represent that you are voluntarily participating in the Activity with knowledge of the danger involved and hereby agree to accept and assume any and all risks of injury, death, or property damage, whether caused by the negligence of the Releasees or otherwise. BY PARTICIPATING IN THIS ACTIVITY, ON BEHALF OF YOURSELF AND YOUR PERSONAL REPRESENTATIVES, HEIRS, SPOUSE, GUARDIANS, EXECUTORS, ADMINISTRATORS, SUCCESSORS, ASSIGNS AND NEXT OF KIN, YOU HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR HEREAFTER KNOWN IN ANY JURISDICTION THROUGHOUT THE WORLD, AGAINST THE RELEASEES THAT MAY ARISE OUT OF OR BE ATTRIBUTABLE TO THE ACTIVITY (INCLUDING, BUT NOT LIMITED TO PERSONAL/EMOTIONAL INJURY, WRONGFUL DEATH, PROPERTY DAMAGE, AND ALL OTHER HARMS, RISKS AND DANGERS ASSOCIATED WITH COVID-19), WHETHER ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES, THE INHERENT RISKS ASSOCIATED WITH THE ACTIVITY, OR OTHERWISE. YOU REPRESENT THAT YOU WILL NOT MAKE OR BRING ANY SUCH CLAIM AGAINST THE RELEASEES, AND FOREVER RELEASE AND DISCHARGE THE RELEASEES FROM LIABILITY UNDER SUCH CLAIMS. YOU FURTHER ACKNOWLEDGE AND AGREE THAT THE RELEASEES SHALL NOT BE RESPONSIBLE FOR, AND YOU HEREBY EXPRESSLY RELEASE THEM FROM ANY CLAIMS FOR NEGLIGENCE OR OTHERWISE WITH RESPECT TO, THE SELECTION OF ANY THIRD PARTY VENDOR(S) USED IN CONNECTION WITH THE ACTIVITY (INCLUDING FOOD VENDORS AND TRANSPORTATION VENDORS), AS WELL AS THE ACTIONS OR INACTIONS OF ANY SUCH VENDOR. Except where prohibited by law, by participating in this Activity, you hereby grant permission to Dapper Labs, Inc., the NBA and its affiliates, and those acting under their authority to use your name, photograph, voice, likeness, and performance during and/or in connection with the Activity, if applicable, and biographical information for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation, notification or permission.
