BEVERLY, MA — A man from Beverly is suing Massachusetts and the MBTA after he fell asleep onboard a commuter rail train, missed his stop, and injured his arm while leaving the storage yard after hours.
Joshua Lemaitre, of Beverly, filed the action in Salem Superior Court last week, according to The Salem News.
On May 8, 2019, a Newburyport/Rockport line commuter rail let its passengers off at Newburyport, but according to the suit, Lemaitre claims crews failed to make a final check before moving the train to a storage area, and missed him while he was sleeping. When Lemaitre tried to get out of the car and leave the lot, he says he fell and injured his left arm.
"We take the safety of our passengers seriously and otherwise will respond to any allegations set forth in a lawsuit in the proper forum," Keolis spokeswoman Sheri Warrington said, adding that the company cannot respond because it has not yet seen the court filing.
