Drivers must register for event to be in the parade. A GTHS Senior must be in the car. Check in and line up at 5pm. Parade starts at 6pm. (Acknowledgement required for registration Original signature required during check in)GRAND TERRACE HIGH SCHOOL SENIOR PARADEACKNOWLEDGMENT OF RESPONSIBILITY, INDEMNIFICATION, EXPRESS ASSUMPTION OF RISK AND RELEASE OF LIABILITYParticipant Name: _______________________________________________________ Parent / Legal Guardian Name: ____________________________________________ (if Participant is under 18 years of age) PARTICIPANT understands that participation in the Senior Parade (defined below) may expose PARTICIPANT and any of their respective heirs, executors and assigns, to a variety of hazards and risks, foreseen or unforeseen, which are inherent in and cannot be eliminated from this community activity. These inherent risks include, without limitation, the dangers of serious personal injury or illness (including, without limitation, exposure to COVID-19, personal injury, disability, and death), property damage, and death, and that the organizers of the Senior Parade (defined below) have not tried to contradict or minimize PARTICIPANT’s understanding of theserisks. PARTICIPANT understands that injuries and damages can occur by natural causes or activities of otherpersons, animals, and those assisting with the Senior Parade (defined below).PARTICIPANT understands that they have been granted permission to participate in the Senior Parade (defined below) and further confirms their understanding that: • The Senior Parade for the Class of 2022, consists of a parade route beginning at De Berry Street (in front of Terrace Hills Middle School) and ending at Main Street, in front of the Colton Unified School District, Grand Terrace High School located 21800 Main Street, Grand Terrace, CA 92313 (“Senior Parade”). • The Senior Parade will begin promptly at 6:00 p.m. at De Berry Street and will terminate no later than 8:30 p.m. at Main Street. • Line-up for the parade will begin at 5:00 p.m. at De Berry Street as noted above. • Drivers, passengers, participants, and participating vehicles (“Parade Vehicles”) shall adhere to all applicable law, including, without limitation, the California Vehicle Code, and the Grand Terrace Municipal Code, and any applicable COVID-19 regulations. • All passengers, participants, and participating vehicles must remain seated at all times and must wear seatbelts. • Drivers must present a valid California Driver’s License prior to being allowed to participate in the Senior Parade. • Parade Vehicles must stay on the Senior Parade route and cannot enter or exit the Senior Parade route once the Senior Parade begins, unless directed by the San Bernardino County Department Deputies. • Parade Vehicles shall not exceed 10 mph for the duration of the Senior Parade and while in the Senior Parade route. • There will be a suspension of traffic, but not street closures are permitted for this event. • No vehicles shall block street intersections. • There shall be no throwing or passing items to/from vehicles or bystanders. • No truck bed riding shall be permitted and cars shall stay in the far right lane. • No window paint on the front windshield or driver/passenger windows shall be permitted. Window paint is only permitted on the rear window. • No balloons shall be permitted inside and outside of vehicles. • No smoking, texting, and activities which would violate applicable law (including, without limitation, the California Vehicle Code, and the Grand Terrace Municipal Code, and any applicable COVID-19 regulations) is allowed inside any Parade Vehicle during the Senior Parade and while in the Senior Parade Route. This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable. PARTICIPANT, acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk of being exposed to or infected by COVID-19, and that such exposure or infection may result in personal injury, illness, permanent disability, or death. PARTICIPANT acknowledges that participation in certain activities may pose a higher risk of being exposed to or infected by COVID-19. PARTICIPANT further acknowledges that the risk of becoming exposed to or infected by COVID-19 at the Senior Parade may result from the actions, omissions, or negligence of themselves and others, including, without limitation, City of Grand Terrace employees, volunteers, or other participants. To the fullest extent allowed by law, and in order to participate in the Senior Parade, PARTICIPANT on behalf of themselves, and any of their respective heirs, executors and assigns, agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS, RELEASE, and FOREVER DISCHARGE the Senior Parade volunteers; the property owners owning property along the Senior Parade route; the City of Grand Terrace, its employees, officers, agents, or representatives; and any other authorized Senior Parade sponsors or safety personnel, including, without limitation, any officers, directors, employees, agents and leaders of the above-mentioned parties, (“Indemnified Parties”) from any and all claims, demands, injuries or illnesses (including, without limitation, exposure to COVID-19, personal injury, disability, and death), damages, causes of action or obligations whatsoever, including, without limitation, attorneys’ fees (“claims”), which may arise out of or in connection with the Senior Parade, including, without limitation, the acts, omissions, or negligence (but not the gross negligence) of the Indemnified Parties. PARTICIPANT on behalf of themselves, and any of their respective heirs, executors and assigns, hereby agrees to WAIVE and relinquish any and all of the above claims or rights PARTICIPANT or any of their respective heirs, executors and assigns may have against the Indemnified Parties in connection with the Senior Parade and covenants not to sue the Indemnified Parties in connection with the Senior Parade. PARTICIPANT has read this document in its entirety and, on behalf of themselves, and any of their respective heirs, executors and assigns, freely and voluntarily ASSUME ALL RISKS of any and all of the above claims, and accept sole responsibility for any claims that they may experience or incur in connection with their participation in the Senior Parade. PARTICIPANT understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the City, its employees, officers, agents, or representatives. PARTICIPANT on behalf of themselves, and any of their respective heirs, executors and assigns, understand that this Agreement may be pled as a complete bar and defense to any action or other proceedings instituted or filed by PARTICIPANT or any of their respective heirs, executors and assigns, against the Indemnified Parties on account of any matter contained herein. Notwithstanding such risks as described herein, PARTICIPANT on behalf of themselves, and any of their respective heirs, executors and assigns, agrees to participate in the Senior Parade.
