DELRAY BEACH, FL — A 74-year-old Delray Beach man shot another man walking his dog at the Kings Point Golf Course Sunday evening Robert Levine shot Herbert Merritt in the ankle just before 7 p.m. at hole 15 on the course, according to Palm Beach County Sheriff's Office arrest report. The victim also had several abrasions on the left side of his body and his left arm. The shooter was detained by deputies after they arrived at the golf course, and they found a handgun in his pocket. Both Merritt and Levine were brought to the Delray Medical Center for treatment. The victim told detectives that Levine drove over to him on his golf cart and began yelling at him for walking his dog on the grass next to the golf course. The suspect then took out a gun and began shooting at Merritt as he ran away, chasing him around a tree, PBCSO records show. The victim said Levine shot about five rounds at him. One bullet hit Merritt's left ankle, causing him to fall on his face. One witness told deputies that after Merritt fell, Levine kicked him in the head. The shooter then took a golf club from his golf cart and began hitting the victim, who was still on the ground, with it. Investigators found "two golf clubs with blood like substance on the face," as well as 9mm shell casings at the scene. Levin was charged with attempted first-degree murder, aggravated battery with a weapon and discharging a firearm in public.
