Proposition 207 also known as the Smart & Safe Act was passed by Arizona voters in 2020 legalizing personal possession and use of recreational marijuana. It also allowed for people who had arrests or prior convictions for possession of marijuana to have those records expunged.
Expungement means that prior marijuana-related records will be sealed to the public. Prior convictions and arrest records can be a significant barrier to gainful employment safe housing education financial assistance and other critical services. The clinic will help individuals understand the legal process and provide free legal assistance to get people through the legal process.
What offenses qualify for expungement?
(1) Possession consumption or transportation of 2.5 ounces (70 grams) or less of marijuana with no more than 12.5 grams in the form of marijuana concentrate.
(2) Possession consumption or cultivation of six marijuana plants or less which must be at the individual's primary residence for personal use.
(3) Possession use or transportation of paraphernalia relating to the cultivation manufacture process or consumption of marijuana.
