FLANDERS, NY — A Flanders man was arrested Sunday night after he drove drunk with three children in his SUV and almost hit a New York State trooper in Riverhead, police said. According to New York State Police, at 8:05 p.m. the trooper was traveling east on Hubbard Avenue when Francisco Andres-Miguel, 45, who was driving a 2007 Honda Pilot, crossed over into the eastbound lane and into the trooper's path. The trooper and the driver of a vehicle behind the trooper drove up onto an embankment to avoid a collision, police said. The trooper immediately turned around and conducted a traffic stop on the Honda, police said. While interviewing Andres-Miguel, the trooper detected the smell of alcohol and performed standardized field sobriety testing, which Andres-Miguel failed, police said. Andres-Miguel was arrested and charged with two counts of felony driving while intoxicated — he had a prior conviction and also, was charged with aggravated DWI with a child, Leandra's Law — as well as with endangering the welfare of a child, a misdemeanor, police said. In addition, Andres-Miguel had an active stay-away order of protection preventing him from being with the three children in the vehicle, and as a result, he was also charged with second-degree criminal contempt, a misdemeanor, police said. Andres-Miguel was arraigned in town of Riverhead Justice Court and was remanded to the Suffolk County correctional facility, police said.
