Freehold Attorney Disbarred, Charged With $71K Theft

FREEHOLD, NJ - A Freehold resident was charged Friday with theft of $71,000 in client funds during the sale of a Middlesex County home, the Middlesex County Prosecutor's Office announced Friday. Bert T. Lundberg, 56, of Freehold was charged during a virtual court appearance with one count of third-degree misapplication of entrusted property and one count of third-degree theft by failure to make required disposition of property received. Lundberg formerly operated out of an Old Bridge practice on Englishtown Road. The charges come following an investigation conducted by Det. Andrew Winter of the Middlesex County Prosecutor's Office, who determined that the Freehold resident received a $71,000 down payment from the home buyers to be held in his attorney trust account. However, after the home closing on November 26, 2019, the deposited money was never forwarded to the homeowners. On March 3, 2020, Lundberg voluntarily consented to disbarment as a result of the New Jersey Office of Attorney Ethics Investigation, the prosecutor said. Lundberg was admitted to the New Jersey State Bar in 1991. The investigation is active and is ongoing.
