The NYC Special Riggers Association cordially invites you attend our technical event at Club 101 on Thursday, March 24,2022 TOPICS TO BE DISCUSSED: Construction Wage Theft Law - Presented by Richard B. Ziskin, Esq. of The Ziskin Law Firm, LLP he will be discussing New York Labor Law Section 198-e, which is known as the Construction Wage Theft. This new law places joint and several liability on general contractors for their subcontractors’ wage and hour pay practices. Section 198-e holds the General Contractor, both jointly and severally liable, for a subcontractor’s unpaid wages, benefits, wage supplements, and any other remedies available pursuant to the requirements of NY Labor Law Section 198. The liability extends to wage claims for minimum wage, overtime, liquidated damages, attorneys’ fees and penalties for statutory claims.Prior to this law, a general contractor would not be responsible for its subcontractor’s wage practices or liability to their employees unless it was found to be a “joint” employer, which, under applicable case law, is a difficult burden to meet. Now, general contractors face strict liability for claims associated with the subcontractor’s payroll practices and it applies to all levels of subcontractors. The limitation period for claims against the general contractor will be three years, while the general limitation for wage claims is six years.Rigging the Impossible: Innovating with your Manufacturer - In this presentation, Rik Vandelinde from Winsafe will discuss the process of creating new products to meet and mitigate the challenging physical and regulatory environment in our industry. This will include examples of innovations driven by ideas and challenges faced right in NYC.
