Joliet Police Officer Andrew McCue Won't Stand Trial

JOLIET, IL — The woman who accused 35-year-old Joliet police officer Andrew McCue of domestic violence did not appear in court, prompting the dismissal of criminal charges against McCue by special prosecutor Bill Elward, according to another news outlet. Wednesday was supposed to be the start of the criminal bench trial before Will County Judge Ed Burmila. Instead, the charge was dismissed, and McCue's case is over. The woman who accused of McCue of attacking her had lived with him since August 2014. Last March, McCue was placed on paid leave from work after his arrest on domestic battery charges. In July, Joliet Patch reported that then-Joliet Police Chief Dawn Malec recommended McCue for firing. McCue appealed his termination to an arbitrator rather than to the city's police and fire board. Following Wednesday's court hearing, Patch reached out to the Joliet Police Department for comment on McCue's status with the department. "Officer McCue was recommended for termination and has opted for the case to be heard in arbitration. I do not have knowledge of when that is set to take place," police spokesman Dwayne English responded. Back in March, Joliet Patch reported that officers were sent to a home in the 1300 block of Fitzer Drive for a welfare check. While there, authorities arrested the off-duty Joliet officer on a charge of domestic battery. McCue is also one of four Joliet police officers who are listed as co-defendants in a federal lawsuit by the family of Eric Lurry, who died while in Joliet police custody on Jan. 29, 2020. The other three officers being sued are Sgt. Doug May, Lt. Jeremy Harrison and Officer Jose Tellez. For his domestic battery case, McCue was represented by Joliet criminal defense lawyer Eugene "Gino" Fimbianti. Following Wednesday's dismissal of the charge against his client, Fimbianti declined to comment, indicating he does not grant interviews with reporters.
