ACTON, MA — A developer will have to pay over $3,000 for damaging a sugar maple while installing a new sidewalk. The Board of Selectmen announced at its Monday night meeting that the developer of the two-unit townhouse at 5 Pearl Street must remove the tree, whose root system was severely damaged. After hearing from Tree Warden Ryan Hunt, Selectman Dean Charter and a former tree warden, as well as reviewing the report of an independent arborist, the board ordered the developer to remove the tree in its entirety, including the stump. The company also will be required to repair the sidewalk and pay both a $500 fine as allowed under state law and $3,139 as the value of the tree. The $3,639 will be used to plant trees at that location and elsewhere in West Acton.
