MICHIGAN — Five men accused of plotting to kidnap Gov. Gretchen Whitmer lost their bid to have the case thrown out by a federal judge Tuesday, according to a report from the Detroit News.
The defense claimed FBI agents and informants conspired the case to distract public discontent of Whitmer's handling of the COVID-19 pandemic. But U.S. District Judge Robert Jonker said the defense lack evidence to that claim, the report said.
"Defendants fail to carry their burden because the evidence on both issues is decidedly disputed as it almost inevitably is at this stage of the case," Jonker wrote.
