Mark has indicated he will not testify since the select committee has requested phone records. The committee has subpoenaed and started receiving this same info from the phone providers. The Jan. 6 select committee is preparing to recommend criminal contempt charges against former White House Chief of Staff Mark Meadows if he refuses to appear for a deposition on Wednesday. Chair Bennie Thompson and Vice Chair Liz Cheney issued the threat hours after the former top aide to Donald Trump revealed that he had withdrawn from a tentative cooperation agreement with the panel. A committee contempt vote would send the issue to the full House, which would in turn send the matter to the Justice Department for potential prosecution. DOJ has already backed up one committee referral, charging Trump ally Steve Bannon for stonewalling the panel. “Tomorrow’s deposition, which was scheduled at Mr. Meadows’s request, will go forward as planned. If indeed Mr. Meadows refuses to appear, the Select Committee will be left no choice but to advance contempt proceedings and recommend that the body in which Mr. Meadows once served refer him for criminal prosecution," Thompson and Cheney said in a joint statement.
