WOBURN, MA — A Middlesex Superior Court Judge has set Monday morning as the date the two sides in a lawsuit over Framingham's tied District 3 Council race will present evidence in the case.
Last week, District 3 Councilor Adam Steiner filed a lawsuit to review two ballots counted for his opponent, Mary Kate Feeney, that put them in a 997 to 997 tie. Steiner contends the two ballots were counted for Feeney in error.
Judge Christopher Barry-Smith will review those two ballots on Monday morning, as well as arguments from Steiner's attorneys, and attorneys representing Feeney and the city of Framingham.
Barry-Smith said he might make a ruling on the ballots as early as Tuesday. A second ruling on whether Framingham will need to hold a special election on Dec. 28 — an event the City Council has already ordered — could come by Wednesday, he said.
The hearing will get underway at 10 a.m. on Monday at Middlesex Superior Court in Woburn. The event will not be available to watch via Zoom.
