The vote: The select panel investigating the Jan. 6 insurrection voted unanimously Wednesday to hold former Justice Department official Jeffrey Clark in criminal contempt of Congress, sending the measure to the full House for consideration as soon as Thursday. But Clark also informed the committee he plans to assert his Fifth Amendment right against self-incrimination, complicating the committee’s calculus.
“This is, in my view, a last-ditch attempt to delay the Select Committee’s proceedings,” Chairman Bennie Thompson (D-Miss.) said during opening remarks, noting that Clark never asserted his Fifth Amendment rights during a deposition earlier this month. But Thompson said he would nevertheless give Clark a chance to come back for another deposition and make the assertion on the record.
What does it mean? The committee is still moving forward with the process of holding Clark in contempt but they want to ensure that the process is legally and procedurally sound so that the Justice Department can consider their contempt referral. Giving Clark another chance to appear is part of that process. It’s unclear if the committee’s contempt vote will advance to the House floor this week or be delayed pending Clark’s potential return.
