PERTH AMBOY, NJ — A Perth Amboy-based lawyer who was convicted of aggravated assault against his then-fiancee has now had his license to practice law suspended for six months by the New Jersey Supreme Court. The lawyer is Frank A. Tobias, Jr. He maintained his law office in Perth Amboy. The Supreme Court announced the suspension, which you can read here, last Wednesday, Nov. 17. According to their suspension decision, in January 2020 Tobias pleaded guilty and was convicted of one count of third-degree aggravated assault. He was criminally charged after an incident on December 13, 2018, when court records showed that "he became angry when his then-fiancée confronted him at a restaurant where he was drinking alcohol with friends." According to the legal filing, he and the woman then drove, in separate vehicles, to a parking lot near his office. He "began to yell and curse at M.C. (the woman), and then grabbed her head and 'smashed it against the [vehicle] door frame twice.'" "He then tried to go inside his office but, after M.C. screamed that she was bleeding, he entered his vehicle and fled. A police officer dispatched to the scene observed that M.C. was bleeding from the top left side of her head and called an ambulance, which transported her to a hospital for treatment." On January 6, 2020 Tobias entered a guilty plea to one count of third-degree aggravated assault. Specifically, he admitted that he caused M.C. to sustain a "gash to her head." He was sentenced to three years of probation and random drug and alcohol testing. The court decided to suspend his law license for six months because he committed "a criminal act that reflects adversely on the lawyer's honesty, trustworthiness or fitness as a lawyer."
