Court Rules In Favor Of Puyallup In Warehouse Lawsuit: Report

PUYALLUP, WA — The City of Puyallup has won another legal victory in its battle against Schnitzer West, LLC, according to a new report from The News Tribune. As The News Tribune explains, Schnitzer West, LLC filed a suit against the city over a 2014 ordinance that interfered with the company's plans to build a 470,000-square-foot warehouse on a property near Shaw Road and Pioneer Way East. The city's rule, Ordinance 3067, limited construction to 125,000 square feet. In 2019, the developer filed a suit, arguing that the change had cost the company up to $3 million dollars by cutting the value of their property. By then, the property had since been sold to another company, who has build a warehouse on the lot. But when a Pierce County judge dismissed Schnitzer 's suit, the company appealed the decision — which an appellate court has now struck down the suit a second time. As The News Tribune reports, the court unanimously agreed that the statute of limitations already expired for the equal protection claim, and that the city's actions were protected through legislative immunity. >> Read the rull report from The News Tribune.
