The board had wanted to know if a mandate enacted by Governor Brown that all state employees must be vaccinated by October 18.
The Department of Justice says that any healthcare worker licensed by the state must be in compliance with the mandate or could be found in violation of state law.
After hearing from DOJ, the nursing board drafted the new rule that was then approved by the agency's lawyers.
The board is expecting to hear public testimony from several nurses opposed to the rule.
