CONCORD, NH — A Concord woman is facing another drunken driving charge after being accused of failing field sobriety tests after a police officer found her parked in a lot of a closed business earlier this month. Just before midnight on Sept. 9, an officer stopped to check on an SUV in the parking lot of the CVS on Hall Street. When the officer approached the vehicle, they said the vehicle's engine was running and then, was shut off. A woman opened the vehicle's door and she was talking on a cellphone, a report stated. The officer asked why she was in the parking lot of a closed business and wrote that the woman stated she was waiting for a ride because she had a flat time. The officer accused the woman, later identified as Crystal L. Turner, 33, of Manchester Street in Concord, of having "slurred speech" and smelling like alcohol. During questioning, according to an affidavit, Turner said she had gotten out of work, picked up a friend at Beijing Tokyo, and hit a curb while driving, and now, her tire was flat. Turner agreed to take field sobriety tests and failed the first two and refused to do the third, the officer wrote. "Crystal said she did not know why she was doing these tests and said that she was not driving and did nothing wrong," the officer wrote. "Crystal then said she was not doing any other tests." When told there was one more test, Crystal said, "I'm done doing your tests, I did nothing wrong," the affidavit said, and she was arrested. A second officer conducted an inventory of the vehicle and reported finding fentanyl, two bottles of Fireball liquor, and an empty can of White Claw, according to an affidavit. The officer also reported finding the crash scene — a street marker sign was hit and damaged at the intersection of South Main and Thorndike streets and there was debris from the vehicle near the sign. The debris, according to the report, matched the color and make of Turner's SUV. When informed about other charges, Turner agreed to "talk to me about the fentanyl," the report stated. Turner said she had picked up a friend at The Draft on South Main Street and then, drove forward and hit the curb, the affidavit stated. She stopped at the CVS because she thought the tire was flat, the report added, but denied having fentanyl. She added she did not do drugs and offered to take a drug test, the affidavit stated. A check found that Turner pleaded guilty to driving under the influence in July 2020. According to a post on Patch from December 2019, she was originally charged with aggravated DUI-0.16+ and driving under the influence charges after an incident on South Main Street near The Draft. Turner was charged with driving under the influence-second offense, felony possession of a controlled drug-fentanyl, and conduct after an accident. She was released on bail and had a disposition hearing on Sept. 20. Turner is due back in Merrimack County Superior Court for a dispositional conference on Dec. 14.
