Aug. 31, 2021 -- The U.S. Department of Education’s Office for Civil Rights has launched investigations in five states that prohibit universal mask mandates in schools. The investigations will explore whether statewide rules against indoor masking in Iowa, Oklahoma, South Carolina, Tennessee, and Utah discriminate against students with disabilities who face higher risks for severe COVID-19. “The Department has heard from parents from across the country -- particularly parents of students with disabilities and with underlying medical conditions -- about how state bans on universal indoor masking are putting their children at risk and preventing them from accessing in-person learning equally,” Miguel Cardona, the U.S. education secretary, said in a statement. “It’s simply unacceptable that state leaders are putting politics over the health and education of the students they took an oath to serve,” he continued. “The Department will fight to protect every student’s right to access in-person learning safely and the rights of local educators to put in place policies that allow all students to return to the classroom full-time in-person safely this fall.” The department sent letters to the chief school officers in the five states, outlining how mask mandate bans could prevent school districts from using health and safety policies that are deemed necessary at the local level. The letters state that mask restrictions “may be preventing schools from meeting their legal obligations not to discriminate based on disability and from providing an equal educational opportunity to students with disabilities.” Education officials in Oklahoma and South Carolina said they would cooperate with the investigation and signaled that they were against their states’ bans on mask mandates, according to The New York Times. Officials in Iowa and Tennessee told the newspaper that they received the letters and were reviewing them. The Office for Civil Rights hasn’t yet opened investigations in other states with bans on mask mandates -- such as Arizona, Arkansas, Florida, or Texas -- because the rules aren’t currently being enforced due to court orders or other state actions, the department said Monday. School districts should be able to have universal indoor masking in these states, the department noted. “However, the Department will continue to closely monitor those states and is prepared to take action if state leaders prevent local schools or districts from implementing universal indoor masking or if the current court decisions were to be reversed,” the department said. On Friday, a Florida judge ruled against the state’s ban on school mask mandates and blocked the state Education Department from punishing local school boards for requiring masks. But on Monday, state officials announced that the Florida Department of Education withheld funds from two school districts that made masks mandatory this fall. The department withheld the monthly school board member salaries in Alachua and Broward counties, which will continue each month until the school boards comply with state law. “We’re going to fight to protect parent’s rights to make health care decisions for their children. They know what is best for their children,” Richard Corcoran, Florida’s education commissioner, said in a statement. The Alachua and Broward school districts said they would continue to enforce their mask requirements, according to the Times. “Based on the dramatic spike in cases and quarantines in our schools and community, we believe universal masking is absolutely critical to keeping schools open, protecting the health care of our students and staff and limiting the current strain on our local healthcare system,” Carlee Simon, PhD, the superintendent of Alachua County Public Schools, said in a statement. “If necessary, we will pursue legal action to ensure that we maintain local control over our schools and are able to meet our obligation to provide a safe learning environment for all students,” she said.
