KILL BILL'S HAUNTED TRAPPED HOUSE event starts on Friday October 1st until Monday November 1st.Every day from Friday to Sunday at 6:00 pm to 1:00 amKids under 12 can enter with adults at parents discretion WAIVER AND RELEASE OF LIABILITY (HALLOWEEN HAUNTED HOUSE) PLEASE READ EACH PROVISION OF THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PURCHASE OF THE TICKET(S) AND ENTRANCE INTO THE HALLOWEEN HAUNTED HOUSE. BY PURCHASING A TICKET(S) AND/OR ATTENDING THE EVENT, YOU AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THIS AGREEMENT AND THE CONDITIONS STATED HEREIN, DO NOT PURCHASE THE TICKET(S) OR ATTEND THE EVENT. IF YOU ARE A PARENT OR GUARDIAN PURCHASING A TICKET ON BEHALF OF SOMEONE UNDER THE AGE OF EIGHTEEN, YOU UNDERSTAND THAT THESE TERMS AND CONDITIONS APPLY EQUALLY TO THE MINOR CHILD(REN). THIS WAIVER AND RELEASE APPLIES TO THE HALLOWEEN HAUNTED HOUSE EVENT HOSTED AND/OR SPONSORED BY BILL K. KAPRIE AKA KODAK BLACK (“KODAK”) (THE “EVENT”) FOR WHICH YOU ARE PURCHASING TICKET(S). BY PURCHASING THE TICKET(S) YOU CERTIFY THAT YOU HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND FULLY UNDERSTAND ALL OF ITS TERMS AND CONDITIONS. AT THE EVENT YOU MAY BE REQUIRED TO EXECUTE ADDITIONAL DOCUMENTATION CONSTITUTING RELEASE AND WAIVER OF LIABILITY. YOU WILL NOT BE ALLOWED INTO THE EVENT UNLESS AGREE TO EXECUTE ANY ADDITIONAL DOCUMENTATION PRESENTED TO YOU AT OR BEFORE THE EVENT. THERE WILL BE NO REFUNDS, EXCHANGES, OR RETURNS FOR ANY REASON WHATSOEVER. ASSUMPTION OF RISK: You acknowledge, understand, and agree that the Event offers an interactive and unique environment designed to maximize the fright and anxiety experienced by patrons. As such, the Event has certain, inherent, known, unknown, obvious, and non-obvious risks including but not limited to: falling, sliding, tripping, slipping, being struck or hit by moving objects, being struck or hit by props or people, contact with scenery, and/or contact with other patrons or animals. You acknowledge, understand, and agree that by attending the Event, you assume the risk from the presence of, and/or exposure to the following included but not limited risks: fog, dust, smoke, uneven floors, moving and/or slippery floors, obstacles and/or obstructions in and or along paths and walkways, dim lighting, sudden motions or movements, wildlife, darkness, loud noises, bright lights, strobe lights, loud and violent air blasts, objects or other patrons falling on, jumping, or striking me, acts by yourself or other patrons because of fear, anxiety, dizziness, asthma, impaired vision, and any other physical or emotional conditions, unpredictable and surprising situations, sudden and extreme changes in temperature, friction burns and other abrasions, scratches, burns, or contusions. In addition, the novel coronavirus (“COVID-19”) has been generally declared as a worldwide pandemic and is extremely contagious and believed to spread mainly from person-to-person contact. While rules, guidance, and personal discipline may reduce this risk, the risk of serious illness and death does exist. You understand that the transfer of communicable diseases like COVID-19 cannot be completely mitigated and are aware that participation or attendance in this Event includes possible exposure to an illness, injury, or death from infectious diseases including but not limited to COVID-19. After fully informing myself about the Event, you knowingly and freely assume and accept all such risks, both known and unknown, and assume full responsibility and all risks for your participation in the Event. You also warrant and verify that you am free from all illnesses, injuries, and defects that could interfere with your safe participation in the Event and that you have no condition that will cause a severe reaction to strobe lights, loud noises, sudden movement, startling events, or the viewing of haunters and haunted scenes at the Event. You must also be aware that being under the influence of alcohol and/or medication can materially alter your physical and mental state of mind and cause you to suffer adverse effects while participating in the Event. YOU ACKNOWLEDGE THAT YOUR PARTICIPATION IN THE EVENT IS ENTIRELY VOLUNTARY. RELEASE AND WAIVER OF LIABILITY: You certify and represent that you have the legal authority to waive, discharge, release, and hold harmless the Releasees (defined below) on behalf of yourself and/or any minor child for which you are responsible. By purchasing a ticket and/or entering the Event, you affirm that you have read this Agreement and agree to accept all risks, both specifically identified within this document and unknown, and to forever release and waive Kodak, individually, and any of his businesses, subsidiaries, officers, directors, representatives, officials, principals, agents, employees, affiliates, and volunteers as well as independent contractors, sponsoring agencies, sponsors, and advertisers (hereinafter the “Releasees”), from any and all liability, claims, causes of action, demands, rights, and damages arising from any and all injury, disability, death, and/or loss or damage to person or property, negligence, and/or any reckless act on the part of the Releasees or their representatives, which may result from or in connection with my participation in the Event, to the fullest extent allowed by law, on behalf of yourself, your estate, heirs, administrators, personal representatives, assignees, and successors, and any individual for which you have purchased a ticket for the Event. I understand and agree that this waiver and discharge includes any and all claims against Releasees for any and all liability for any exposure to or illness or injury from an infectious disease including COVID-19. You further consent to the administration of first aid and other medical treatment deemed necessary in the event of injury or illness and hereby release and indemnify Releasees from any and all liability or claims arising out of such treatment. INDEMNITY: You agree to indemnify and hold harmless the Releasees from any and all expenses including but not limited to attorney fees, fines, fees, medical costs, or other costs arising out of any negligence, injury, or illness which may result from or in connection with your participation in the Event including but not limited to exposure to or illness injury from an infectious disease including COVID-19. MEDIA RELEASE: You hereby grant the Releasees the irrevocable right and permission to videotape or photograph the Event and your participation therein and hereby release, discharge, and agree to hold harmless the Releasees from any claims whatsoever arising out of the footage, including claims for libel, misappropriation of image and likeness, or invasion of privacy.
