Description

The beginning of the holiday shopping season. We are looking for small business, craft and direct sales vendor to join our team of vendors . Application and rules. Once a vendor pays, they are agreeing to all rules below. Fees covers vending area, permit and insurance. All fees are NON-REFUNDABLE, and all spaces are on a first paid basis, NO HOLDS. Events may be postponed because of COVID19 (we are hoping not) by the event organizer. If it is, vendors will be refunded. New dates will be communicated to all vendors at least 4 weeks before the new dates to allow for adequate preparation on the part of the vendor. HOURS Holiday Hours will be shared later. VENDING LOCATIONS 1. Vendor Row: Between H&M and Old navy 2. Store space between Bath and Body Works and Express men SETUP/BREAKDOWN Setup starts 1hr before mall opens. Breakdown starts an hour before the mall closes. Arrival 30 minutes before the mall opens will disqualify the vendor and fees paid WILL NOT BE refunded. All vendors should be set up 15 minutes before the mall opens to the public. TABLES AND CHAIRS Vendors will be provided 1 table with tablecloth and 1 chair. However, vendors can use up to two tables, but they would have to bring the other table. Vendors that need to use a rack can either use 2 racks and a table or 2 tables and a rack. Extra table and rack will incur a fee of $25. GENERAL RULES Extra Inventory: All extra inventory should fit under the table or taken back to the car. Vendors shall not store any inventory, equipment or any other materials out-side the Space, or do or permit anything to be done in or about the Space or ap-purtenant common areas which would constitute a nuisance or hazard or which will in any way obstruct or interfere with the rights of other tenants or occupants of the Shopping Center or injure or annoy them. Space Vendors shall occupy and use the Space for the period stated above, commencing on the Start Date/Time and ending on the End Date/Time (‘Term’), unless sooner terminated as herein provided. Vendors also shall only sell items agreed upon. We reserve the right to ask any vendor that do not abide by these rules to leave. Indemnity and Exculpation of Landlord: (a) Tenant shall assume liability for and shall indemnify, defend and hold harmless House of Beulah LLC. Landlord, Land-lord's Property Manager, Simon Property Group, Inc. (and all their respective shareholders, members, partners, directors, officers, related and affiliated enti-ties, ground lessors, managers, employees, and agents) (collectively, 'Landlord Parties') against and from any and all liabilities, obligations, sickness, losses, pen-alties, actions, suits, claims, damages, expenses, disbursements (including legal fees and expenses) or costs of any kind and nature whatsoever in any way relating to or arising out of: (i) any act or omission of Tenant (including without limitation the acts or omissions of the Tenant's officers, directors, employees, agents, contractors, invitees and/or licensees within the Shopping Center); (ii) any occurrence which takes place in or about the Space; or (iii) any damage to the Space. To the extent permitted by applicable law, Tenant's duty to indemnify Landlord Parties under this paragraph will apply regardless of and will extend to cover losses caused by either Tenant's or Landlord Parties' concurrent, compara-tive or contributory negligence. (b) Landlord Parties shall not be liable to Tenant, and Tenant waives all claims against Landlord Parties, for injury, death or damage to person or property sus-tained by Tenant, or any person claiming through Tenant, resulting from any con-dition, accident or occurrence in or upon the Space or any other part of the Shop-ping Center, unless such matters arise from the intentional wrongdoing of Land-lord Parties. (c)To the fullest extent permitted by applicable law, Tenant shall indemnify and save Landlord Parties harmless from any and all claims, demands or suits that may be brought against Landlord Parties by any employee, representative, or agent of Tenant, or any legal representative or successor of any of them, in any way arising out of or incident to this Lease, irrespective of whether such suits are brought about by the negligence or fault of Landlord Parties or anyone for whose acts Landlord may be liable. Space Condition Tenant agrees not to harm the Space, commit waste, create any nuisance, make any use of the space, which is offensive, as determined by Landlord at its sole dis-cretion, or act in a manner tending to injure the reputation of the Shopping Cen-ter. Vendors must return the space the same way it was before set up. All dam-ages will be the responsibility of the vendors. Losses Theft, loss or damage to merchandise and personal property is the sole risk and responsibility of Tenant. Thank you so much for choosing to pop up @ our space.
