Two CMC Employees Accused Of Attempted Privacy Violations

MANCHESTER, NH — Manchester police were notified of an incident at Catholic Medical Center involving a possible violation of privacy and have made two arrests in the case. After an investigation, they determined on June 15 that a device capable of capturing audio and video recordings had been located in a staff bathroom at Catholic Medical Center. During the course of the investigation, it was determined that the device belonged to a nurse, employed by the CMC who police identified as James Kelly, 33, of Derry. The investigation also revealed that a second employee of the hospital, Heather Tempest, 30, of Dunbarton was accused of being directly involved in this incident. As a result of the investigation, Tempest was arrested on July 14 and charged with one count of criminal liability of another, falsifying physical evidence. Kelly was arrested on July 18 and charged with one count of attempted violation of privacy and one count of falsifying physical evidence. According to court documents, both Kelly and Tempest were released on personal recognizance bail. Alex Walker, the president and CEO of the hospital, released a statement on the incident saying, "On behalf of CMC employees, I would like to thank Manchester police for their dedication to this case. The trust we have in each other as colleagues, as well as the safety and comfort of our staff, are incredibly important to us all. We have appreciated the support and sensitivity MPD has shown our employees through this difficult incident."
