SANDY SPRINGS, GA — The City of Sandy Springs Public Facilities Authority and Holder Construction Group have reached an agreement following a dispute regarding City Springs. At the close of the construction of the $239 million City Springs project, a disagreement occurred regarding payments due under the contract between Holder Construction Group and the City of Sandy Springs Public Facilities Authority. In September 2019, the Authority filed a counterclaim in a lawsuit brought by Holder in Fulton County Superior Court over the Authority's right to withhold payment until all work was successfully completed. In its counterclaim to the lawsuit filed by Holder in August 2019, the Authority said it was seeking damages from Holder for breach of contract, negligent construction and fraud. Now, the dispute and related construction questions have been resolved, or a solution determined, the city said on Tuesday. Both parties have agreed to dismiss all claims, the Authority will pay $1.8 million to Holder, concluding the contract. The Authority's civil action against the Rosser architectural firm is awaiting a decision from Fulton County Superior Court. Holder was selected in June 2015 as Construction Manager at Risk to build the City Springs development, a $229 million project that includes the Sandy Springs Performing Arts Center, City Green, an underground parking garage, and municipal offices.
