I am a licensed attorney in the Boston area. My work has been limited to residential real estate conveyancing. I have no experience with civil litigation or other formal court proceedings.
I would like to file an action for breach of implied warranty of merchantability (Massachusetts General Laws, Part I, Title XV, Chapter 106, Article2, Section 2-314) related to windows that I installed in my home. The windows were produced by a premium national manufacturer (very high end) and they have failed. My rough estimate of the damages (i.e. what it would cost for me to replace these windows with a product that is similarly positioned in the marketplace) is $50,000. I am unclear as to how any relevant statute of limitations would apply.
What I am looking for is an experienced attorney to both evaluate this claim and then assist or mentor me through filing and trying the case). I am not willing to pay an attorney an hourly rate for this help but I would be happy to work out a payment if the project succeeds.
Please respond with your experience and any thoughts you have regarding how the mentoring relationship would be structured.
