Jenkinson's Point Beach Suit Dismissed, Wanted Alcohol On Beach

POINT PLEASANT BEACH—A lawsuit filed by the owners of Jenkinson's against Point Pleasant Beach and borough officials was dismissed on Monday in federal court in Newark by Chief Judge Freda L. Wolfson. Lawyers for Jenkinson's and its owners, Anthony and Frank Storino, filed suit against the borough last September, citing multiple instances of the borough overstepping its bounds regarding enforcement issues, including having children check coolers for contraband as well as the banning of alcohol on the beach since Jenkinson's is a privately owned establishment, including the beach. "The precedent this would set is monumental," Point Pleasant Beach Mayor Paul Kanitra said in response to the filing back in September. said. "It is a fight for the very soul of Point Pleasant Beach. Kanitra was happy with the decision rendered by Judge Wolfson as he felt it was a huge victory for Point Pleasant Beach. "This is a HUGE victory for the residents of Point Pleasant Beach who now can rest assured that coolers will be properly checked for drugs and alcohol and that consumption will be limited to the ABC designated areas," Kanitra posted on his Facebook page. Also, Judge Wolfson denied the lawyers for Jenkinson's the ability to file for a preliminary injunction regarding the decision rendered today, citing "an inability to demonstrate a likelihood of success on the merits," but they do have 14 days to file an amended complaint. An email for comment was sent to Toby Wolf, Director of Marking for Jenkinson's, but he did not immediately respond with a comment on today's ruling.
