Description

Any law that protects a person's property from other creditors is called an exemption. All exemptions that are listed in the Bankruptcy Code of the United States are called federal bankruptcy exemptions. These exemptions are applicable only in bankruptcy cases, irrespective of which state an individual is in. Let us take a look at some of the latest bankruptcy exemptions of 2021. Homestead Exemption A homestead exemption lets you protect up to $25,150 of the equity in your home. However, this need not apply to an investment property or second home. Individuals can apply this exemption to any unimproved land on which they plan to reside in the future with help of an attorney. The same exemption can also be applied to a mobile home that is located on a rented property. In most cases, individuals can apply this exemption to one property because they can only have one homestead. However, if an individual and his/her spouse file for bankruptcy, don't live together, maintain separate homesteads, and don't have a financial connection with each other, then they are allowed to claim a separate homestead. Personal Property Exemptions Individuals are allowed to keep up to $13,400 in personal property.
