GC BISTRO GINCARLO CUCUMO ITALIAN FINE DINING If I wouldn't have walked into that restaurant asking for a job... I was employed as a server at GC Bistro in Morro Bay, CA. A few weeks of working in the restaurant, the owner, Giancarlo explained how he needed urgent help with his 8 year old disabled son, Angelo. He asked if I would be interested in providing live in care and that I would be paid $25 an hour. I accepted the job as Angelo's nanny and also worked nights at the restaurant. After two and a half months Giancarlo made me feel extremely uncomfortable by making suggested advances. He mentioned his wife had passed away and he needed companionship. I began searching for another job and place to live and planned on terminating my nanny position as well as GC Bistro as soon as something became available. Angelo and I were putting up Christmas decorations one evening in the house when suddenly Giancarlo slammed the front door open after returning from work. He said it was obvious I was not interested in him and told me he would not need my services any longer. He demanded the house key returned and told me to get out of his house immediately. I knew he had been drinking from the smell on his breath. Returning the key, he told me I could pick up my belongings the following morning at 11:00am. Leaving the house, I asked when I could pick up my paycheck and get my belongings. EVERYTHING I OWNED ($11,000 property) WAS IN THE HOUSE INCLUDING MY IPAD!!! After handing him my house key, he told me I could get my belongings and check the following morning at 11:00am. I arrived the following morning at 10:30am. I waited until 1:00pm continually knocking on the door with no answer and no answer to my calls. Every day for two weeks, I would arrive at the house unsuccessfully attempting to collect my belongings and final paycheck. I decided contacting the local authorities for a civil standby. I arrived at the house to meet an officer and was told to wait in my vehicle until talking with Giancarlo. Approximately twenty minutes later the officer returned to my vehicle stating "Ma'am...you must vacate the premises immediately...Mr. Cucumo claims you have never lived here and every item in the house belongs to him." The officer would not allow me to explain any further only asking if I had any proof of residency such as mail received at the address.. I explained that I had. a PO Box in Morro Bay and never received any mail at the home. He then confirmed there was nothing he could do and this was now a civil matter. I was abruptly escorted off the premises as Giancarlo watched from his window. The following day I returned to the restaurant to ask for my things.. he yelled "GET OUT! DONT EVER COME BACK HERE...I AM FILING A RESTRAINING ORDER!" I drove to the Courthouse in San Luis Obispo to file a lawsuit against Giancarlo where I waited in line for most of the afternoon. As I approached the court clerk to file my claim, she insisted that I was "wasting my $75 filing fee.."Unfortunately you just ran into one of the most evil people in San Luis Obispo County. Mr. Cucumo has nine people ahead of you that have filed lawsuits against him...he has no assets....you won't get a dime." I spent almost a year pursuing an employment attorney but they were unsuccessful also at all attempts to even file my claim being unable to contact Giancarlo. I was completely devastated and defeated..the fight in me was gone... The authorities would no longer assist me, and so I unfortunately decided to take matters into my own hands. Not caring about the consequences, I broke into the bedroom window of the house. My items we're scattered in the room as I tried to retrieve as much as possible. A woman approached me at the doorway asking who I was as she was on the phone with the police. I panicked and ran out of the back door throwing what I had in my arms beside the neighbors fence. Giancarlo since then has pressed vandalism and theft charges on me (all for trying to get my belongings returned) Never being in trouble legally, now a felony criminal charge lingers under my name preventing me from obtaining any work or even applying. After relocating back to the bay area, my car registration was two months past due...it was towed away off the street and there was no way I could get it out with all the fees involved. None of my belongings have ever been returned to this day...not even my final paycheck. I left with the clothes on my back in the middle of winter and am now living in a1994 run down motorhome by myself....I am so sad I don't know what to do anymore...I don't know how to get out....I need help. please. leaving with nothing but the clothes on my back... living out of my car in the middle of winter.... am currently homeless not able to QUALIFY for a job..... I live in a I just thought maybe someone would read this and understand where I am coming from...I need help. Thank you for reading. Chantal
