Press release from the City of Carlsbad: April 9, 2021 The Carlsbad City Council unanimously adopted and approved the City of Carlsbad's updated housing plan for submission to the state. The City of Carlsbad is required by state law to update its housing plan to ensure the city is meeting the housing needs of all members of the community. This includes updating city housing policies and designating space for about 3,900 new housing units by 2029. The City Council approved the following policy amendments to the housing plan update that were proposed by the public, Planning Commission and Housing Commission: Included a program from smoke free housing Designated Site 13 – Zone 20 (located at the corner of Poinsettia Lane and Brigantine Drive) a low priority potential housing site that would only be included if another alternative site could not be identified in the southwest quadrant Removed the Ponto property from the potential housing sites with direction to find an alternate housing site elsewhere in the same quadrant Added a program objective to evaluate and consider the expansion of live-work units within commercial, citywide The City Council also passed a resolution stating the city's housing caps are preempted by state laws. After reviewing the draft housing plan, the state directed the city to adopt such a resolution in order to comply with new state housing laws that limit the ability for cities to impose building moratoriums and housing caps. Without the resolution, the state warned that the city's updated housing plan may not be certified. Without a state-certified housing plan the city would no longer be eligible for state grants to help fund infrastructure projects, could face fines and penalties and would be put at risk of housing-related lawsuits, which threaten the city's ability to have a say in how or where housing should go. To help oversee and guide the review of the housing plan update, the City Council created the Housing Element Advisory Committee in September 2019. The committee, made up of a group of residents representing different parts of the city, held 14 meetings to review, hear public comments and provide input on the draft housing plan. Additional public outreach included an online public input survey, informational video and materials, project webpage, social media and opportunities for public review of several versions of the draft housing plan along the way.
