WHITE PLAINS, NY — A man accused of assaulting a Korean-American woman in White Plains will be released. A statement Tuesday from Westchester County District Attorney Miriam Rocah said, in the course of the investigation into the March 9 incident, the assistant district attorneys handling the case found issues with aspects of the man's identification. "Our office immediately notified defense counsel for the subject," Rocah said in a news release. The man has been in custody since March 11, and his defense counsel said an application for his release on his own recognizance will be submitted Tuesday. Rocah said her office plans to consent to the application for release. Nancy Toh, 83, was collecting bottles and cans for money around 7:30 p.m. outside of The Westchester mall when a man came up to her, spit in her face and then punched her in the nose. She called the police a day later, and a homeless man was taken into custody and charged with assault. The matter remains under investigation by the DA's office.
