NEW BERLIN, WI— A lawsuit against the City of New Berlin has been resolved, according to a news release.
In late 2019, the City of Waukesha brought a lawsuit against the City of New Berlin related to the City of New Berlin's denial of approval for the City of Waukesha to locate its booster pump station and reservoir facilities in a portion of Minooka Park. The two communities were able to reach an agreement on a settlement of that litigation, which included the movement of the booster pump station and associated reservoirs to a location within the City of Waukesha. That agreement was contingent upon approval of the movement of these facilities by the State of Wisconsin Public Service Commission.
The PSC has, in fact, approved that relocation and the construction of the booster pumpstation and reservoirs in the City of Waukesha. Based upon that approval, the two communities reached a further stipulation that the present lawsuit filed by the City of Waukesha could now be dismissed and that Stipulation for Dismissal has now been approved through an Order from Circuit Court Judge Michael O. Bohren.
"The City of New Berlin is pleased that a mutually acceptable resolution of these issues hasbeen reached that allows for the residents of the City of Waukesha to have a safe andreliable water supply, while also recognizing the ability of the citizens of the City of NewBerlin to regulate the use of lands within their community," the release said.
