Curious as to what I should do

So Saturday morning I was finishing up my shopping at Walmart. Hop in my car slowly back out while using mirror of course. Then I look back and this van is backing out as well.i completely stop beeping my horn,and the driver isn't even paying attention and backs into car causing damage. She says oh this is my mom's car but she is in Mexico, well you got insurance I do but I dont have the insurance info with me.eventually she gets the info we exchange.I call my insurance and let them know what happened etc.they didn't even bother to call there insurance to file a claim so I did.so I I casually ask her if they filed yet already knowing the answer. Should I let it play or just get an attorney and let the handle everything.
