The First Amendment merely states that Congress shall make no law abridging the freedom of speech. Where does it say you're immune from the repercussions of what you say? tRump's lawyers say his words are protected by the First Amendment, that he can say whatever he wants, have they never heard of libel? Slander? Character assassination? Threats? All these things are punishable by fine and imprisonment, surely they know the constitution doesn't protect his words from being found guilty in an impeachment trial! They know incitement is punishable EVEN IF THE OFFENSE IS NOT CARRIED OUT! If the offense IS carried out, they are subject to a prison sentence half the sentence of the offense itself. The lawyers KNOW their case holds no water, they are attempting to give the Republicans in the Senate a way to dismiss the case in a constitutional basis because they know he's guilty as hell of inciting insurrection. They are also trying to say a president who's no longer in office cannot face an impeachment trial. Thomas Jefferson is one of the framers of the constitution, he didn't claim holding an impeachment trial was unconstitutional when he was president of the Senate in America's first impeachment trial where William Blount was already gone from office. Before tRump, no president has ever had more than 5 House members from their own party vote for impeachment, tRump doubled that record. Before tRump, no Senator from their own party, voted guilty in an impeachment trial, tRump is the first. Only 4 impeachments of presidents in our 245 years as a nation, HALF OF THOSE ARE tRUMP! Only 3 impeachments in the last 150 years, TWO THIRDS ARE tRUMP'S! With Nixon, rather than face a member of their party be impeached, the Republicans in the Senate marched to the White House and told Nixon he had to resign to save them from having to remove him. tRump will likely be acquitted, the Republican cowards would rather destroy their own party than go against the POS that took it over. tRump could have conceded the election but he incited an insurrection instead. He endangered every member of Congress INCLUDING the very Senators who are STILL too scared stand up to him. Even one guilty vote from a Republican would be historical, a handful would send a strong message but a unanimous vote would be the only honest and just outcome.
