On Jan. 7, 2021, Governor Charlie Baker issued an Order extending the time period on therestriction on the number of patrons allowed in retail licensees' premises to 25% capacity limit.
This includes licensees that sell alcohol for consumption both on- and off-premises. A summaryof the Governor's Order extending this time period can be found HERE.
As the Governor ordered on Dec. 22, all retail licensees are restricted to a 25% capacitylimit. This applies to indoor and outdoor seating separately.
For off-premise licensees, the 25% capacity limit is calculated by the occupancy load as stated ona licensee's certificate of inspection issued under the State Building Code.
For on-premise licensees, the 25% capacity limit is based on a licensee's seating capacity.Questions regarding seating capacity should be directed to your local licensing authority.Workers/staff are excluded from the occupancy count.
These limits are now in effect until Jan. 24, unless further extended by the Governor.
