Kickstands up at 7:00 AM. We are riding from Harley-Davidson of Rochester to Mount Washington. This is about a 90 mile ride which takes about 2 hours. There will be one stop at a rest stop for a gas and restroom break. Waiver and Liability Release Event: Ride to the Sky Date: June 12, 2023 Time: 7:00 AM Location/Facility: Harley-Davidson of Rochester Host: Harley-Davidson of Rochester As a requirement to participating in the above-referenced event (Ride to the Sky) I agree as follows: I fully understand and acknowledge that: (a) the Event to take place has inherent risks, dangers, and hazards that exist in participation in such activities; (b) my participation the Event and/or use of any equipment or services may result in property loss and/or injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death, or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence or carelessness of the owners, agents, officers, affiliates, volunteers, employees, or landlord of the Host; the negligence or carelessness of other participants or persons; accidents; breaches of contract; theft; the forces of nature; terrain; or other causes; (d) risks and dangers may arise from foreseeable or unforeseeable causes, including, but not limited to, motorcycle and/or other vehicle crashes, fires, explosions, slips, falls, and all other dangers associated with the Event; (e) these risks are not only inherent to riders, but are also present for passengers, spectators, and volunteers; and (f) by my attendance or participation in the Event and use of equipment and/or services, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence, carelessness, or other conduct of the owners, agents, officers, affiliates, volunteers, employees, and landlord, if any, of the Host (the “Releasees”) or by any other person or entity. I hereby also agree to the following: (1) I am aware of the risks and hazards involved in participating in the Event, as well as any associated use of services or equipment, chemicals, gases, or other materials associated with the Event, including, but not limited to, ingress and egress at the facility, walking, climbing stairs, lifting, participating in motorcycle riding and/or viewing the Event; (2) I voluntarily participate, although knowing such dangers, and hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify the Releasees from and against any and all liabilities, claims, demands, losses, actions and causes of action whatsoever, including, but not limited to, bodily injury, property damage, property theft, wrongful death, loss of services, or otherwise that may arise out of my participation in the Event or use of equipment and/or services or presence at the facility owned or operated by the Host; (3) I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the Releasees; (4)This release shall be binding upon the administrators and/or executors of my estate, my heirs, and distributes; (5)The venue of any dispute that may arise out of this agreement or otherwise between the parties shall be in the superior court of Rockingham County, New Hampshire; and (6) This release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law, and if any portion of this waiver and release is held to be invalid, such invalidity shall not be construed to invalidate any other provisions of this release and waiver. I agree to indemnify and hold harmless and promise not to sue the Host and Releasees, and I agree to pay all court costs and attorneys’ fees that result from an action being brought against the Host or Releasees on my behalf as a result of or on account of the Event. I agree to observe all federal, state, and local laws, and to ride safely and defensively. I and any passenger(s) agree to wear appropriate personal protective equipment as required by law. If I or my passenger(s) choose to ride without a helmet, I/we do so at my/our own risk. I will never ride under the influence of alcohol or drugs. My motorcycle and all required personal protective equipment are in safe operational condition. I agree to abide by the directions/rules given by the Host or its designees and understand that my privilege to ride or otherwise participate in the Event may be revoked without refund if I am in violation of the rules set forth or if I am acting/performing in an unsafe manner, or in any manner disruptive to the operation of the Event. I have read the above waiver and liability release and by signing it agree it is my intention to exempt and relieve the Releasees from liability for personal injury, property damage, wrongful death, and any other claim, whether caused by negligence or any other cause. I certify that I am at least 18 years old, or that my parent or guardian has signed this waiver and liability release on my behalf.
