We’ll then move inside for our panel presentation of the evening where our panel of U.S. and European litigation and prosecution experts will cover a number of the most vexing patent issues that stakeholders need to know about in 2023. Panel Presentation Title:(Patent) Fear & Loathing in Silicon Valley – A Global Update A panel of patent experts from the U.S. and Europe will cover all of the patent developments in 2023 you need to know. The panel includes patent litigators, prosecutors, and licensing experts from Europe and the U.S. to address the issues from all sides. Topics to include: • Key developments regarding prosecution, assertion, and defense for patent stakeholders to know • Key aspects and developments regarding patent litigation in the U.S., Europe, and the U.K.• Latest expectations regarding Europe’s new Unified Patent Court including how it fits with the European patent litigation system and cross-border disputes involving non-E.U. companies/patents • SEP-FRAND issues, including how courts in Europe, China, and the United States have addressed those questions and how the UPC is likely to address them • Patent office opposition procedures in the U.S. and the E.U., including PTAB proceedings and EPO opposition procedures Our distinguished panel will discuss new developments in patent law and practice from a comparative perspective, analyzing in particular how the new Unified Patent Court in Europe will change patent practices and litigation strategies worldwide, as well as how various national courts and policy makers have tried to address the challenges of FRAND licensing, standard-essential patents, and aligning incentives to innovate with deterring frivolous litigation. The panelists also will discuss different approaches to patent prosecution and administrative proceedings before patent offices in Europe, the United States, and the United Kingdom, and the opportunities presented by, for example, European Patent Office opposition proceedings versus U.S. Patent Trial & Appeal Board actions.
